Apparently, shockingly, Kevin Lowe didn't before he made the Vanek & Penner offer sheets. Lowe had to ask NHL head office if the 1st round pick he had to give in compensation for any offer had to be his own, or any first round pick he had acquired (he wanted to have the option of losing the Anaheim pick from the Pronger trade). It's pretty clear, in black and white, that it had to be your own pick in the CBA.

And Burke didn't know Penner was eligible for team initiated arbitration.

And, as we know, Buffalo really got lazy and stuck with the Vanek offer.
